1. Definitions
In the following terms & conditions “The Photographer” shall mean Sophie Mutevelian trading as Sophie Mutevelian Photography. “The Client” shall be the organisation or individual in direct communication with the Photographer to book her services. The client cannot vary these terms & conditions in any way unless such conditions are expressly agreed by the photographer in writing.
2. Copyright & Credit
The entire copyright of the Photographs is retained by the Photographer at all times throughout the world as stated by the 1998 Copyright, Designs and Patents Act. The photographs must be credited with the Photographer’s name where possible when used for print and online publicity.
3. Display
The Client hereby allows the photographer to display any images covered by this contract and to generally promote her business by means of advertising, publicity material, websites, exhibitions, competitions, magazine articles, and other such media, providing that the images are used lawfully and without damage to the clients. Images placed in password protected online galleries are not available to the general public in the normal course of events. However it may not always be possible to prevent determined persons from accessing these galleries.
4. Exclusivity
Unless agreed in writing and the invoice, no exclusivity is given or implied to the Client. The Photographer retains the right in all cases to use or sell the Photographs. Exclusivity will not be unreasonably withheld but only on written agreement with the Photographer before work commences.
5. Licence and Coverage
a) The photographer shall be granted artistic licence in relation to the shots taken and the locations used. Although every effort will be made to comply with the Clients’ requirements, the photographer’s judgment and number of photographs taken shall be deemed correct.
b) Whilst the photographer shall endeavour to fulfil all the Clients’ requirements, they cannot be held responsible for non-availability of subjects or adverse conditions which may delay the progress of proceedings, preventing the coverage of certain specified shots.
c) Any alterations made to the booking by the Clients once details have been confirmed may only be made at the discretion of the photographer. If unable to accommodate alternative arrangements the photographer is not liable to compensate the client in any way whatsoever.
7. Payment and Prices
a) Payment by the Client will be expected for the commissioned work within 30 days of the issue of the relevant invoice. If the invoice is not paid, in full, within 30 days the Photographer reserves the right to charge interest at the rate prescribed by the Late Payment of Commercial Debt (Interest) Act 1998 from the date payment was due until the date payment is made.
b) Additional hours worked on the day, over and above the hours included in the fee, will be charged at £125 per hour. If additional hours are required this should be arranged prior to the job date. Alternatively, if additional hours are incurred on the job, it will be added to the invoice.
8. Expenses
Where extra expenses or time is incurred by the Photographer as a result of alterations to the original brief the Client shall be liable to pay such expenses or fees to the Photographer. For locations outside London, the Client will be required to cover cost of travel and if required to provide overnight accommodation for the Photographer. Locations within London are covered in the cost of the Photographer’s fee. Return journeys in excess of 50 miles may attract a mileage charge of 45p per mile.
9. Rejection
Provided the brief has been fulfilled there is no right to reject on the basis of style or composition.
10. Cancellation and Postponement
A booking is considered firm as from the date of confirmation. At the Photographers discretion, cancellation or postponement will incur the following charges:
1. Cancellation within 7 working days of the job date will incur 100% of the total fee.
2. Cancellation within 10 working days of the job date will incur 50% of the total fee.
It is essential to inform the photographer as soon as possible of any changes of location, times, or contact details etc.
